Cocktails to go will remain legal in California until 2029 after Gov. Gavin Newsom signed AB2663\.

Cocktails to‑go were temporarily permitted in California during the COVID‑19 pandemic to help businesses stay afloat and provide flexibility for consumers, but that ability was set to expire in December.

“Adult consumers can continue to enjoy hand-crafted cocktails from their favorite restaurants in the comfort of their homes for another three years,” said **Adam Smith**, svp-state government relations, **Distilled Spirits Council of the U.S.** “Cocktails to-go have become a popular part of the takeout experience, giving Californians more choice and convenience while helping restaurants better serve their customers. We thank Gov. Newsom and the Legislature for extending this popular option and delivering a win for consumers and local businesses across the state.”

AB 2663 allows restaurants to sell cocktails to-go in manufacturer-sealed containers (such as canned or bottled cocktails) or in containers with secure, sealed lids. Cocktails must be sold with a meal.

Since the start of the pandemic, 33 states and the District of Columbia have made cocktails to-go permanent, reflecting strong consumer demand and proven success for on-premise businesses. New York and California continue to allow cocktails to-go on a temporary basis.
