Fawn Weaver Seeks 'Pause' in Uncle Nearest Assets Sale

You've got to hand it to Fawn Weaver and her team of lawyers. Weaver, of course, is the founder and former CEO on Nearest Green Distillery and associated entities.

Six days after the receiver in the Nearest Green Distillery receivership told the judge overseeing the matter that he believed he was close to an agreement with a new potential buyer to acquire the assets of the distillery, Weaver files an emergency motion for a preliminary injunction to prevent the receiver from reaching an agreement.

Judge Charles E. Atchley Jr. was plainly irritated – not by the fact she sought to delay the sale as much by the fact that she sought a preliminary injunction order be issued just 24 hours after it was issued. "A preliminary injunction order is 'an extraordinary remedy which should be granted only if the movant carries his or her burden of proving that the circumstances clearly demand it'," he wrote.

So, he ordered Mid-America Farm Credit and Philip G. Young, the receiver, to respond to Weaver's motion by 12 noon Monday (10/19) and Weaver to respond no later than 5 p.m. Wednesday (10/21) at 5 p.m.
