NAWR Files Amicus Brief in North Carolina Direct Shipping Case

National Association of Wine Retailers filed an amicus curiae brief with teh U.S. Supreme Court support B-21 Wines' appeal of a 4th U.S. Circuit Court of Appeals decision upholding a North Carolina states that allows in-state retailers to ship to North Carolina consumers while denying that privilege to out-of-state retailers.  

In its brief, NAWR notes the 4th Circuit decision creates a split between circuits.  "If allowed to go unresolved, will sow confusion amongst the lower courts on the proper legal standard to apply when considering the constitutionality of discriminator state alcohol laws," the brief states.    It also contends teh 4th Circuit decision misconstrues legal doctrines developed by the Supreme Court in Granholm and Tennessee Wine.
